Tenants may conduct radon tests themselves or hire a certified professional under chapter 136B to test their dwelling unit

Tenants must provide landlords written notice of test results showing radon levels at or above 4 picocuries per liter (the EPA action level)

Landlords may conduct a confirmatory test by a certified professional; if confirmed at or above 4 picocuries per liter, or if no confirmatory test is conducted, landlords must install a certified radon mitigation system and retest within 90 days

Tenants may terminate their lease without penalty if the landlord fails to install a mitigation system within 90 days or if radon levels remain at or above 4 picocuries per liter after installation, with full return of prepaid rent and deposit

Termination may be effective immediately or on a mutually agreed later date to allow the tenant to find alternative housing
