Creates a new criminal offense of "smuggling of persons" targeting those who knowingly transport, harbor, or conceal noncitizen individuals for payment or other benefit

Prohibits using vehicles, aircraft, or watercraft to transport noncitizens with intent to conceal them from peace officers or flee from law enforcement

Criminalizes encouraging individuals to enter or remain in the U.S. illegally by concealing or harboring them, and directing two or more individuals onto agricultural land without owner consent

Classifies the base offense as a class "C" felony, elevated to class "B" felony if the offense creates substantial likelihood of serious injury or death, involves a child under 18, is committed for pecuniary benefit, or involves firearm possession

Imposes class "A" felony penalties if the smuggled individual becomes a victim of first or second degree sexual abuse, or suffers serious bodily injury or death

Provides an affirmative defense for actors related to the smuggled individual within the second degree of consanguinity or affinity
