Requires open enrollment requests for English learners to be granted only if the receiving district has an appropriate special instruction program that meets the student's educational needs and has sufficient capacity without exceeding maximum class sizes or caseloads.

Mandates the student's district of residence pay the receiving district the state cost per pupil plus additional weighting funds assigned to English learners under section 280.4, subsection 3.

Requires the district of residence to pay additional costs to the receiving district when actual special instruction costs exceed the English learner weighting funds transferred.

Allows receiving districts to deny open enrollment if accepting the English learner would cause the special instruction program's class size or caseload to exceed state board of education limits.

Applies to open enrollment applications filed on or after the effective date of the Act.
