Deployers of chatbots must implement protocols to detect, respond to, report, and mitigate potential user harm while prioritizing user safety over business interests, and must limit data collection to what is necessary for the chatbot's purpose.

Minors (under 18) are prohibited from using or purchasing chatbots unless the deployer implements reasonable age verification through government ID, financial documents, or other widely accepted methods.

Mental health chatbots may be made available to minors only if designed for therapeutic purposes, recommended by a licensed professional after evaluation, supported by peer-reviewed clinical trial data, and accompanied by clear AI disclaimers.

The Attorney General may enforce violations through injunctions and civil penalties of up to $2,500 per violation or $7,500 for violating an injunction, with penalties deposited into the state general fund.

Parents, guardians, or custodians of minors who use non-compliant chatbots may bring private actions to recover between $100 and $750 or actual damages, whichever is greater.
