Cities must adopt ordinances regulating the burial of human remains on private property within city limits that is not operated as a cemetery.

Ordinances must at minimum require the person authorized to conduct burials to submit documentation notifying the county or city that a burial occurred on the property.

Counties and cities must allow burials on private property if all applicable state and federal laws and regulations are met.

Counties and cities assume no liability for damages caused by burials on private property.
