Motor vehicle dealers licensed under Chapter 322 are deemed to possess right, title, and interest in a vehicle if the certificate of title is issued or assigned to an entity with direct ownership or control over the dealer

Dealers must store all records at their place of business or at a U.S. location of an entity with direct ownership or control, and must provide electronic records to the department within 24 hours of request

For remote sales, dealers or their controlling entities must possess the certificate of title at the time of sale, which may be in an electronic format through a department-approved secure system (not PDFs, scanned copies, or emails)

Dealers conducting remote sales must disclose to buyers whether the vehicle is located out of state, whether the title is electronic, and provide an estimated delivery date

Remote motor vehicle sales are explicitly excluded from door-to-door sale regulations under Chapter 555A
