Defines graffiti as any painting, writing, or inscription applied to public or private surfaces without owner consent, regardless of content or materials used.

Establishes misdemeanor penalties of up to 1 year in county jail and/or a fine up to $1,000 for basic graffiti violations.

Creates felony penalties when damages from a single violation exceed $1,000 or when multiple violations aggregated together exceed $1,000 in value.

Establishes felony penalties for persons with two or more prior graffiti convictions within a 5-year period.

Sets felony punishment at a fine of $1,000 to $5,000 and state prison sentence of 1 to 5 years, or both.
