House Bill 510 - Employment Security Law Amendments

• Defines "decision" as written rulings by the department's appeals bureau or commission, and "determination," "revised determination," "redetermination," or "special redetermination" as written departmental rulings that include notice of appeal rights.

• Grants the director discretion to determine the method of paying benefits and refunds from the Employment Security Fund.

• Establishes a five-year statute of limitations for the director to commence administrative proceedings to enforce contribution payment provisions, with tolling during employer absconding or concealment.

• Revises appellate procedures by allowing the director to either transfer appeals directly to an appeals examiner or issue a redetermination affirming, reversing, or modifying the original determination.

• Permits the director to compromise overpayments, civil penalties, interest, and 52-week disqualification periods when determined to be in the department's best interest.
