House Bill 527 Summary

• Amends Idaho Code Section 72-528 to require sureties, self-insurers, the state insurance fund, and noninsured employers to report all litigation expenses to the Industrial Commission upon request, including attorney fees, witness costs, depositions, investigations, and filing fees.

• Requires attorneys representing claimants in worker's compensation claims to report all attorney's fees and litigation expenses charged to the claimant upon request by the Industrial Commission, extending to any appeals to higher courts.

• Specifies that required reports must be filed with the Industrial Commission within 30 days following the date of the request, which occurs after entry of an award or after a final ruling by a court in cases of appeal.

• Authorizes the Industrial Commission to establish rules for compliance and permits the commission to refuse to allow non-compliant attorneys the right to appear before it.

• Applies these requirements to all cases in which an application for hearing is filed with the Industrial Commission on or after July 1, 1988.
