House Bill 599 Summary

• Adds Section 39-7421 to Idaho Code to authorize the director to issue research, development, and demonstration (RDD) permits for municipal solid waste landfills (MSWLFs) that test innovative methods varying from standard requirements.

• RDD permits may allow variances from run-on control systems, liquid restrictions, and final cover criteria, provided the landfill demonstrates protection of groundwater, surface water, and maintains leachate depth under 30 centimeters on the liner.

• Permits are limited to three-year terms with a maximum total term of twelve years including renewals; applicants must submit annual reports documenting project progress, monitoring results, and achievement of project goals.

• Applicants must pay nonrefundable fees ($250 for initial application, $100 for renewal) plus reimburse the department and health district for all reasonable review and oversight costs, with initial deposits of up to $2,500 required before review begins.

• Certain landfills are ineligible for RDD permits, including small facilities (20 tons per day or less), those with prior groundwater contamination or landfill gas exceedances that lack remedies, and those operating under existing exemptions.
