Agencies may incorporate material by reference in rules if cumbersome to include in full text, provided they include in the notice of proposed rulemaking a brief written synopsis explaining why incorporation is needed.

Agencies must note where copies of incorporated material may be obtained or electronically accessed, with minimum availability on the agency's website and the office of the rules coordinator's website.

Agencies must provide one copy of incorporated material and electronic copy or link to the Idaho Supreme Court Law Library if otherwise unavailable.

Agencies must prepare and deliver a statement of economic impact to the director of legislative services for all proposed rules in which a fee or charge is imposed or increased, including reasonably estimated implementation costs to the agency and citizens/private sector.

The adequacy of economic impact statements is not subject to judicial review.
