Operating a vehicle or combination of vehicles exceeding registered maximum gross weight without a valid permit constitutes a violation under infraction or misdemeanor provisions of Idaho Code section 49-1013.

First violation during harvest season for vehicles transporting fresh agricultural produce or raw cut timber from field to market results in written warning only, provided excess weight is due to mud, snow, or ice.

Second or subsequent violations during the same harvest season are subject to penalties without warning exemption.

Gross weight measurement of agricultural produce or timber transport vehicles must be conducted in areas with the lowest possible motor vehicle congestion to ensure public safety.
