Prohibits any person from operating a motor vehicle on a public highway while using a cellular telephone to initiate, answer, or participate in a verbal call.

Exempts cellular phone use for reporting traffic accidents, medical emergencies, fires, serious road hazards, personal safety threats, criminal acts, or official duties by law enforcement and emergency personnel.

Allows hands-free devices including headsets, voice-activated systems, and other hands-free technology to be used without restriction.

Establishes violations as infractions punishable by a fine of $75.00 and clarifies that cellular telephones cannot be seized or forfeited under this law unless otherwise authorized.

Amends Section 49-104, Idaho Code to define "cellular telephone" as a wireless telephone utilizing low-powered radio transmitters covering distinct geographical areas and enabling portable telephone service.
