Requires all tobacco product retailers to obtain an annual permit from the Department of Health and Welfare, which is the only retail tobacco permit or license required.

Authorizes the Department of Health and Welfare to promulgate rules regarding permitting, inspections, compliance checks, and employment practices for tobacco retailers.

Establishes annual permit fees to be set at a rate sufficient to recover all costs associated with implementing and enforcing the permitting and inspection programs, with fee receipts directed to the prevention of minors' access to tobacco fund.

Requires permittees to display signage stating that state law prohibits tobacco sales to persons under age 18, requires proof of age, and establishes penalties for violations.

Prohibits permittees from allowing minor employees to sell or distribute tobacco products, though minors may possess tobacco products for non-sales duties such as stocking shelves.
