Legislature declares it is important to protect and encourage free exchange of information and opinions regarding peer review activities, including credentialing.

Receiving and use of peer review information and opinions receives the same legal protections as peer review decisions based on that information.

Furnishing information or opinions to health care organizations, or receiving and using such information in peer review decisions, does not subject health care organizations or other persons to civil liability or actions for damages.

Custodians and persons aware of peer review records, data, and opinions shall not disclose them except as authorized by board of medicine rules or other law.

Health care organizations receiving peer review disclosures must maintain confidentiality and limit use strictly to conducting peer review activities.
