Establishes "The Fairness in Contracting Act" (Section 44-2012) to prohibit contractors, subcontractors, and labor organizations from using union dues, assessments, or wages to provide wage subsidies, bid supplements, or rebates that benefit contractors doing business in Idaho.

Prohibits labor organizations from paying wage subsidies or rebates to members funded by union dues or assessments for the purpose of subsidizing contractors or subcontractors.

Classifies violations as misdemeanors with penalties of up to $10,000 for a first offense, $25,000 for a second offense, and $100,000 for each additional offense.

Grants standing to bidders, offerors, contractors, subcontractors, and taxpayers to challenge bid awards, specifications, project agreements, and grants that violate the act, with successful challengers entitled to recover costs and attorney's fees.

Includes severability clause to preserve the remainder of the chapter if any provision is declared void or unenforceable.
