Senate Bill 1391 Summary

• Creates Chapter 59 of Title 31, Idaho Code, establishing emergency medical services system (EMSS) authorities as political subdivisions to govern emergency medical services in counties with ambulance services, effective no later than January 1, 2012.

• Authorizes two governance structures: county commissioners acting as the EMSS authority board (default), or a separately elected 3-5 member EMSS authority board chosen through general elections.

• Grants EMSS authority boards broad powers including adopting fees for EMS services, issuing certificates of compliance to licensed agencies, developing operations and finance plans, and negotiating service conditions with emergency medical services providers.

• Requires fire protection districts providing ambulance services to obtain EMSS authority board consent before withdrawal and to conform to EMSS authority rate-setting decisions.

• Amends sections 31-1434, 31-3901 through 31-3909, and related statutes to integrate EMSS authority oversight, transfer dissolved fire district property and funds to EMSS authorities, and extend immunity protections to licensed emergency medical services personnel.
