Prequalification of bidders for state construction projects now requires approval from both the Department of Administration and the respective state agency when deemed in the best interest of the state.

Prequalification standards must be based on demonstrated technical competence, experience with similar facilities, prior state experience, past performance quality and timeliness, safety record, available resources, equipment, personnel, and overall performance history.

Two-stage bidding process for prequalified projects: initial stage identifies qualified contractors (prime or specialty), followed by bid pricing stage limited to prequalified contractors only.

Department may promulgate rules or develop procedures to implement the prequalification process, and requests for qualifications must include specific evaluation standards for prospective bidders.

Act declared to be an emergency measure and takes effect immediately upon passage and approval.
