Reduces Fiscal Year 2010 appropriation to Superintendent of Public Instruction/State Department of Education by $502,300 ($25,000 personnel costs, $452,700 operating expenditures, $24,600 trustee and benefit payments) from the General Fund.

Appropriates $33,631,100 to the Superintendent of Public Instruction/State Department of Education for Fiscal Year 2011 from multiple funds: General Fund ($6,558,100), Indirect Cost Recovery Fund ($836,200), Driver's Training Fund ($2,422,800), Public Instruction Fund ($1,457,100), Miscellaneous Revenue Fund ($442,900), and Federal Grant Fund ($21,914,000).

Authorizes the State Department of Education no more than 130 full-time equivalent positions during July 1, 2010 through June 30, 2011, unless specifically authorized by the Governor, with Joint Finance-Appropriations Committee notification required for any increases.

Allows expenditure of up to $120,000 from the Public Instruction Fund for system licensing costs associated with a K-12 longitudinal data system that tracks progress and fosters continuous improvement under the American Recovery and Reinvestment Act of 2009.

Declares an emergency, making the fiscal year 2010 appropriation reduction effective immediately upon passage and approval.
