HB 31 Summary

• Amends Section 42-221 to establish a new fee schedule (Section O) for applications to change the point of diversion, place, period, or nature of use of water under a vested water right, with fees ranging from $200 to $13,220 based on water quantity or storage volume, plus incremental charges for larger quantities.

• Reduces the fee for applications to amend a permit from $100 to $50 under Section 42-221(C).

• Adds an additional $250 fee for any application to change the nature of use of water under one or more vested water rights.

• Amends Section 42-248 to clarify that filing an application to change a water right that shows a change in the owner's address or includes evidence of ownership change satisfies notification requirements, with fee requirements applying in addition to the water right change filing fee.

• Specifies that all fees collected under these provisions shall be transmitted to the state treasurer for deposit in the water administration account.
