Amends Section 39-4403 of Idaho Code to revise the definition of "restricted hazardous waste" in the state's hazardous waste management chapter.

Adds an exemption for byproduct materials, devices, or equipment utilizing such materials that are authorized by the United States nuclear regulatory commission pursuant to the federal energy policy act of 2005, to be disposed of in a commercial hazardous waste facility.

Maintains existing exemptions for radiologically contaminated waste materials from "Formerly Utilized Sites Remedial Action Program (FUSRAP)" sites administered by the United States army corps of engineers with contracts in existence on July 1, 2001, and as may be renewed thereafter.

Preserves the definition of restricted hazardous waste as including wastes regulated as land disposal restricted pursuant to federal statutes and regulations, including 40 CFR part 268.
