HB 169 Summary

• Requires political subdivisions to solicit bids from Idaho nonprofit organizations representing persons with disabilities when procuring services or personal property valued over $25,000, with preference given when bids and quality are equal.

• Defines "nonprofit organization representing persons with disabilities" as tax-exempt organizations under Internal Revenue Code Section 501(c)(3) and "persons with disabilities" to include those with physical/mental impairments substantially limiting major life activities, those with records of such impairments, and those with specific conditions including blindness, deafness, epilepsy, autism, intellectual disabilities, mental illness, orthopedic disorders, or cerebral palsy.

• Amends state procurement procedures to require the Division of Purchasing to seek bids from Idaho nonprofit organizations representing persons with disabilities and give preference when bids and quality are equal.

• Adds responsibilities to the Idaho State Council on Developmental Disabilities to solicit and maintain listings of qualified Idaho nonprofit organizations representing persons with disabilities for state contracting purposes.

• Sections regarding definition of terms take effect July 1, 2013; all other provisions effective immediately upon enactment.
