House Bill 206 - Poultry Environmental Act

• Creates the Poultry Environmental Act establishing a permit system administered by the Idaho Department of Agriculture for constructing, operating, or expanding poultry concentrated animal feeding operations (CAFOs) of any size.

• Requires existing large and medium poultry CAFOs to register by January 1, 2012, and submit nutrient management plans within one year; prohibits 10% or greater capacity increases without a permit.

• Establishes design and construction standards for wastewater storage facilities using natural resources conservation service or ASABE standards, with Department of Agriculture approval superseding Department of Environmental Quality review.

• Creates a Poultry Inspection Fund through annual fees based on confinement area square footage (not exceeding 3 cents per square foot) to cover inspection and administration costs.

• Authorizes civil penalties up to $10,000 per violation and permit revocation for material violations or misrepresentation; civil penalties are credited to the state school building fund.
