House Bill 256 Summary

• All plumbing and plumbing systems in Idaho must be designed, constructed, installed, improved, extended and altered in substantial accord with the Idaho State Plumbing Code, as amended by the Idaho plumbing board through negotiated rulemaking.

• The Idaho plumbing board must conduct a minimum of two public hearings with at least thirty (30) days' written notice to implement amendments or revisions to the plumbing code.

• Cities implementing plumbing code enforcement programs must adopt the Idaho State Plumbing Code by ordinance, including any amendments made by the board.

• Cities may further amend the Idaho State Plumbing Code to address local concerns if amendments provide at least equivalent protection and cities conduct a public hearing with thirty (30) days' notice to the board and other prescribed entities.

• Cities cannot adopt amendments that have not been adopted by the board, have been expressly rejected, or directly conflict with board amendments, except when good cause and reasonable necessity are found and proper procedures are followed.
