All administrative rules that would expire on July 1, 2011, shall continue in full force and effect until July 1, 2012, when they shall expire as provided in Idaho Code Section 67-5292.

Rules affirmatively approved or extended by concurrent resolution of both the Senate and House of Representatives in the First Regular Session of the Sixty-first Idaho Legislature shall remain in effect until July 1, 2012, or until any earlier expiration time provided in the rule or by statute.

Rules rejected by concurrent resolution of both chambers in the First Regular Session of the Sixty-first Idaho Legislature shall be null, void, and of no force and effect.

Agencies may amend or repeal rules continued under this act according to procedures in Idaho Code Chapter 52, Title 67, subject to legislative approval.

This act does not constitute legislative approval of extended rules, does not give them greater legal status than other administrative rules, and does not establish a finding that rules are consistent with their enabling statutes.
