House Bill 276 Summary

• Appropriates $3,367,800 in additional funds to the Department of Correction for fiscal year 2011 (July 1, 2010 - June 30, 2011) from federal grants and general funds for management services, prisons administration, private prisons, correctional alternative placement, community corrections, education and treatment, and medical services.

• Appropriates $173,489,500 to the Department of Correction for fiscal year 2012 (July 1, 2011 - June 30, 2012) from multiple fund sources including general fund, inmate labor fund, parolee supervision fund, miscellaneous revenue fund, penitentiary endowment income fund, and federal grant fund.

• Exempts the Department of Correction from Idaho Code Section 67-3511 transfer limitations for both fiscal years 2011 and 2012, allowing unlimited transfers between object codes and between programs, though legislative appropriations cannot be transferred between different funds without express legislative approval.

• Authorizes the Department of Correction with no more than 1,556.93 full-time equivalent positions during fiscal year 2012, with the Governor authorized to increase positions if the Joint Finance-Appropriations Committee is promptly notified.

• Declares an emergency for Sections 1 and 2 of the act, making those provisions effective upon passage and approval.
