Adds Section 40-1305D to Idaho Code to establish a transition schedule for highway district commissioner elections held in odd-numbered years.

Commissioners elected in 2007 serve full terms expiring October 1, 2011; those elected in 2008 expire July 1, 2013; those elected in 2009 expire October 1, 2013; and those elected in 2010 expire July 1, 2015.

Commissioners elected in 2011 serve four-year terms beginning July 1, 2011, and expiring July 1, 2015.

If a 2007-elected commissioner does not seek reelection or is defeated in 2011, their replacement takes office October 1, 2011, instead of July 1, 2011.

Act is declared an emergency and takes effect upon passage and approval.
