Defines "bicycle helmet" as a head covering meeting Consumer Product Safety Commission (CPSC) standards or equivalent nationally recognized standards, equipped with a neck or chin strap that must be fastened while the bicycle is in motion.

Requires children 12 years of age or younger to wear a bicycle helmet when operating or riding as a passenger on a bicycle on any roadway.

Makes parents or guardians responsible for ensuring their child wears a bicycle helmet in compliance with the law.

Establishes civil penalties of $25.00 for the first offense and $50.00 for each subsequent offense against parents or guardians who fail to enforce helmet use.

Allows courts to dismiss charges if evidence is presented that the parent or guardian has purchased a helmet for the child and instructed proper use; requires political subdivisions to retain half of collected penalties and remit the other half to the state treasurer.
