Department of Health and Welfare shall promulgate rules establishing annual permit fees for tobacco product retailers to recover costs of implementing and enforcing permitting and inspection programs.

Permit fee receipts shall be remitted to the prevention of minors' access to tobacco fund established in Idaho Code section 39-5711.

Tobacco retailers must display signs at each location where tobacco products are sold stating that state law prohibits sales to persons under 18 years old and warning of fines and penalties.

Retailers are prohibited from allowing minor employees to sell or distribute tobacco, though minors may stock shelves or carry purchases if not selling the products.

Section 39-5716 is amended to correct the code reference for cautionary language requirements on delivery sales advertisements and websites from section 39-5704(67).
