Amends the fiscal year 2011 appropriation to the Superintendent of Public Instruction by increasing personnel costs from $8,655,000 to $9,305,000 and decreasing operating expenditures from $22,708,900 to $22,058,900 (total appropriation remains $33,631,100).

Appropriates $34,586,400 to the Superintendent of Public Instruction for fiscal year 2012 (July 1, 2011 through June 30, 2012), distributed across personnel costs ($9,823,200), operating expenditures ($22,475,900), capital outlay ($55,800), and trustee and benefit payments ($2,231,500).

Limits the Superintendent of Public Instruction to no more than 133 full-time equivalent positions during fiscal year 2012, unless specifically authorized by the Governor, with required notification to the Joint Finance-Appropriations Committee.

Declares an emergency for Section 1 (fiscal year 2011 amendment) to be in full force and effect upon passage and approval.
