HB 370 - Idaho Compassionate Use Medical Marijuana Act

• Establishes registration system for qualifying patients with debilitating medical conditions (seizure disorders, epilepsy, spasticity, glaucoma, terminal cancer, ALS, multiple sclerosis, and other conditions approved by department) to obtain registry identification cards valid for 2 years.

• Permits registered patients and designated caregivers to possess up to 2 ounces of usable marijuana without criminal penalty, arrest, or civil/administrative penalties.

• Creates alternative treatment centers authorized to cultivate, process, and dispense marijuana to registered qualifying patients; first 2 centers in each state region must be nonprofit entities.

• Prohibits marijuana use while operating vehicles, smoking in public transportation, schools, correctional facilities, or public parks; subjects violators to applicable penalties.

• Requires Department of Health and Welfare to establish registry, conduct background checks for caregivers and center employees, maintain confidential patient records, and report annually to governor and legislature on program implementation.
