Idaho Health Insurance Exchange Act (HB 433)

• Creates an independent public body corporate called the Idaho Health Insurance Exchange to facilitate purchase of health benefit plans by individuals, eligible employees, and eligible employers.

• Establishes a 9-member board (7 voting, 2 ex officio nonvoting) appointed by the governor and confirmed by the senate, with representation from small businesses, consumers, faith-based organizations, minorities, women, and community health organizations.

• Requires the board to adopt a plan of operation by December 1, 2012 that establishes community rating requirements, ensures no more than 25% out-of-pocket health insurance costs, preserves primary and preventive care, and identifies revenue sources to make the exchange self-sustaining.

• Imposes strict conflict of interest provisions prohibiting board members from contracting with or holding positions in entities subject to the exchange's regulation.

• Requires navigators to register with the director of insurance and prohibits licensed insurance producers from serving as navigators; navigators must provide culturally and linguistically appropriate information to populations served.
