HB 585 Summary
-
Nonschool taxing districts may certify budget requests exceeding normal limitations under Idaho Code section 63-802 for the sole purpose of paying final court judgments entered after December 1, 2010, including interest, costs, and attorney's fees.
-
Judgment payment levy authority requires the district to first budget the maximum allowed amount, use all surplus funds toward the judgment, and demonstrate the judgment amount exceeds one-third of the district's highest annual budget from the preceding three years.
-
The amount exceeding normal limitations may not increase the budget more than a 0.1% levy rate, and the levy may be levied only until the judgment is paid in full.
-
Judgment payment levies can be paid through cash, redeemable warrants, bonded indebtedness, or any combination of these methods, and are excluded from calculations of property tax revenues financing annual budgets.
-
County boards of commissioners may issue bonds to pay judgments meeting the criteria established in the new section 63-1305A, and the state tax commission may promulgate rules to administer these provisions; the act takes effect retroactively to January 1, 2012.
