Amends Section 59-1302, Idaho Code, to revise the definition of "employee" under the Public Employee Retirement System.

Clarifies that substitute teachers and substitute assistants working on a day-to-day basis without a contract are not considered employees for retirement purposes.

Excludes positions in seasonal or casual employment lasting eight (8) consecutive months or less with local government entities (cities, counties, irrigation districts, cemetery districts, or mosquito abatement districts) from the definition of employee.

Excludes persons in optional retirement program positions under sections 33-107A or 33-107B, Idaho Code, from the definition of employee.

Declares an emergency, making the act effective immediately upon passage and approval.
