House Bill 635 Summary

• Extends all administrative rules scheduled to expire on July 1, 2012, to continue in full force and effect until July 1, 2013, when they shall expire under Idaho Code Section 67-5292.

• Rules affirmatively approved or extended by concurrent resolution during the 2012 legislative session continue in full force and effect until July 1, 2013, or until an earlier expiration date specified in the rule or by statute.

• Rules rejected by concurrent resolution during the 2012 legislative session become null, void, and of no force and effect as provided in Idaho Code Section 67-5291.

• Allows agencies to amend or repeal continued rules according to the Administrative Procedure Act procedures and subject to legislative approval submission, without granting these rules any additional legal status.

• Declares that extending rules' force and effect does not constitute legislative approval or a finding that rules are consistent with legislative intent of their authorizing statutes.
