Amends Section 49-104 of Idaho Code to define "cellular telephone" as a wireless telephone utilizing low powered radio transmitters covering distinct geographical areas and enabling large-scale portable telephone service.

Adds new Section 49-1431 prohibiting any person from operating a motor vehicle on a public highway while using a cellular telephone to initiate, answer, or participate in a call.

Exempts from the prohibition individuals using cellular phones to report traffic accidents, medical emergencies, fires, serious road hazards, personal safety threats, criminal activity, or those performing official duties as law enforcement or emergency vehicle operators.

Allows use of cellular phones with headsets, voice-activated devices, or other hands-free equipment while operating a motor vehicle.

Establishes violation of the prohibition as an infraction punishable by a $75.00 fine and clarifies that cellular phones cannot be seized or forfeited under this law unless otherwise authorized.
