S1337 Summary

• Repeals Section 18-1507A (possession of sexually exploitative material for other than commercial purpose) and consolidates sexual exploitation offenses under Section 18-1507.

• Expands the definition of "sexually exploitative material" to include real-time visual depictions such as video chat, webcam sessions, and video calling involving minors engaged in explicit sexual conduct.

• Revises sexual exploitation penalties: possession or access to sexually exploitative material is punishable by up to 10 years imprisonment and/or $10,000 fine; production, distribution, or promotion offenses are punishable by up to 30 years imprisonment and/or $50,000 fine.

• Updates multiple sections of Idaho Code (18-8304, 19-3004A, 19-5506, 33-1208, 39-1113) to remove references to repealed Section 18-1507A and consolidate related provisions.

• Maintains legislative findings on the commercial sexual exploitation of children and establishes that possession of three or more identical copies creates presumption of commercial purpose.
