AI Summary

Senate Bill 1342 Summary

  • Establishes the "Open Access to Work Act" prohibiting Idaho state and political subdivisions from requiring contractors, subcontractors, material suppliers, and carriers on public works projects to pay employees predetermined wages, wage rates, or specific types and amounts of employee benefits.

  • Exempts requirements when federal law mandates prevailing or minimum wages for projects funded wholly or partly by federal funds.

  • Prohibits governmental entities and construction managers from requiring bidders and contractors to enter into or adhere to pre-hire agreements, project labor agreements, or collective bargaining agreements with labor organizations, and from discriminating against bidders for refusing to sign such agreements.

  • Allows bidders, offerors, contractors, subcontractors, and material suppliers to voluntarily enter into labor agreements without prohibition.

  • Grants standing to interested parties including bidders, offerors, contractors, subcontractors, and taxpayers to challenge violations and provides for recovery of attorney's fees and costs if the challenge prevails.

  • Applies to contracts executed after the effective date and does not interfere with rights protected by the National Labor Relations Act.
