Amends Section 40-1309 of Idaho Code regarding corporate powers of highway districts.

Allows highway commissioners to sell personal or real property valued at $5,000 or less at private sale or regular board meeting without advertisement.

Requires commissioners to adopt a resolution and conduct a public hearing before disposing of property exceeding $5,000 in value, with notice published per section 40-206, Idaho Code.

Mandates that adjacent property owners be notified first and given the option to purchase surplus real property at current appraised value before public sale, with a private auction held if multiple adjoining owners want to purchase.

Prohibits highway district commissioners, directors, employees, and their families from having any personal or indirect interest in purchasing property for district use or in selling district property, unless otherwise authorized by law.
