Increases direct wage requirement for tipped employees from $3.35 per hour to $4.00 per hour, effective immediately upon enactment.

Requires direct wages for tipped employees to increase by $1.00 at the beginning of each state fiscal year starting July 1, 2014, until July 1, 2016.

Mandates that by July 1, 2016, the direct wage for tipped employees must conform to and track with the federal minimum wage.

Requires employers to make up the difference if tips combined with direct wages do not equal the minimum wage, with the burden on employers to demonstrate actual tips received by employees.

Excludes tips shared through tip pooling or similar arrangements from counting toward an employee's tips for minimum wage calculation purposes.
