HB 130 Summary

• Establishes that director terms commence at the regularly scheduled board meeting closest to the date specified in section 34-106, Idaho Code, and continue for three (3) years until successors are elected and qualified.

• Requires candidates for director to be nominated through nominating petitions signed by at least six (6) electors in districts with fewer than 100 resident electors, or at least twelve (12) electors in larger districts, filed 40-60 days before election.

• Mandates nominees submit an oath certifying they meet qualification requirements under section 43-111, Idaho Code, and authorizes the district secretary to disqualify nominees who no longer meet requirements before the election.

• Provides that if no director is elected and qualified at the end of an incumbent's three-year term, an election shall be held at the next regular election for the successor to serve the remainder of the unexpired term, applying retroactively to cases where incumbents remain in office due to 2012 election failures.

• Modifies the canvassing process to require the board of directors meet on or before the first Monday after the next regularly scheduled board meeting following election, with the secretary entering the result on board records rather than maintaining full entries like a county recorder.
