House Bill 201 Summary
-
Fire protection district boards may declare by resolution their intention to deannex property they determine is no longer in the public interest to include within the district.
-
Property owners may petition the fire district board for deannexation of their property by paying a reasonable fee determined by commissioners to cover proceeding costs.
-
Commissioners must establish a hearing date and provide public notice at least 30 days prior, mailing notice to adjoining property owners and publishing notice 2-3 times in newspapers depending on publication frequency.
-
After holding a public hearing and considering all information, commissioners must decide whether deannexation serves the public interest based on special hazards or difficulties to fire and life preservation services, with the decision supported by written findings of fact and conclusions of law.
-
Upon ordering deannexation, commissioners must certify a copy to the county board of commissioners, which shall record the order and exclude the deannexed property from tax rolls.
