H0248 Summary
-
Establishes the Idaho Health Insurance Exchange as an independent body corporate and politic governed by a 19-member board (17 voting members) appointed primarily by the governor with legislative representation and subject to senate confirmation.
-
Creates a state-based, voluntary health insurance marketplace that allows individuals and small employers to select and purchase health benefit plans; explicitly prohibits any requirement for persons or employers to participate in the exchange.
-
Grants the exchange powers to adopt bylaws, assess fees from participating carriers and users, contract for services, and develop operational plans, while requiring annual independent audits and subjecting bylaws to director approval.
-
Prohibits the exchange from requiring participation or penalizing non-participation, prevents inquiries about firearm ownership, mandates data security certification before collecting applications, and requires the exchange to be financially self-supporting without state funds or taxing authority.
-
Declares an emergency effective date and allows the Governor to issue a proclamation suspending Idaho's compliance obligations if the federal Department of Health and Human Services changes the exchange establishment date or eligibility limitations.
Legislative Description
