Idaho State Lottery shall immediately withhold and transfer prize moneys to the Department of Health and Welfare upon notification to collect child support delinquencies, with the set-off becoming final only after specified conditions are met.

Prize winners must receive notice of proposed set-off by registered or certified mail and may file a written protest within 14 days requesting a hearing before the Department of Health and Welfare, with the hearing to be held within 35 days.

The Department of Health and Welfare must issue findings and decision within 10 days of the hearing, and the set-off procedure becomes final after the department's decision is issued or if the prize winner fails to file a timely protest.

Lottery prizes are subject to immediate withholding and set-off to collect support delinquencies or state taxes owed upon notification from the Department of Health and Welfare pursuant to section 56-203E or from the State Tax Commission pursuant to section 63-3060.

Proceeds from the set-off shall be credited to an account designated by the Department of Health and Welfare, with notice given to the appropriate clerk of the district court.
