House Bill 404 Summary

• Revises definition of "repeat offender" for DUI/DWI purposes to mean one conviction within 5 years (for certain sections) or 10 years (for other sections) for driving while intoxicated or under the influence of alcohol and/or drugs

• Changes ignition interlock device requirements from discretionary to mandatory for repeat offenders, requiring installation for not less than one (1) year on vehicles owned or operated by offender

• Expands eligibility for restricted driving privileges in drug courts and mental health courts to include those with ignition interlock systems installed, after serving 45 days of absolute suspension

• Establishes calibration setting of .025 for ignition interlock devices and requires Transportation Department to provide certification and installation standards by rule

• Requires alcohol evaluations for DUI/DWI convictions and court consideration of evaluation results in sentencing; permits courts to waive evaluation under certain circumstances
