Removes the sunset provision for annual assessments on private hospitals' inpatient and outpatient services, changing from a limited duration (fiscal years 2009-2011) to ongoing assessments based on each hospital's net patient revenue.

Revises the assessment base determination to use a rolling yearly schedule of Medicare cost reports rather than fixed historical years, allowing the base to be updated annually on a consistent schedule.

Changes upper payment limit distribution calculations to use a rolling yearly schedule for both inpatient and outpatient adjustment payments, instead of fixed calendar years, with payments made within 30 days of the final assessment deposit.

Declares an emergency clause, making the act effective immediately upon passage and approval.
