Requires persons, firms, corporations, or other entities to file an application with the Idaho Department of Water Resources before withdrawing water from Idaho sources and transporting it for use outside the state or changing the purpose of use to an out-of-state location.

Directs the director to approve applications only if the out-of-state water use is consistent with section 42-203A(5), Idaho Code, and consider factors including Idaho's water supply, current and anticipated state water demands, whether water could alleviate state shortages, and water availability in the destination state.

Allows the director to condition permits to ensure out-of-state water use is subject to the same regulations and restrictions applied to in-state water use.

Requires applicants to designate an agent in Idaho for service of process and legal notices upon submitting an application.

Permits the director to require applicants to provide a certificate from the destination state confirming the intended use would be beneficial and the appropriation is feasible.
