Idaho legislature opposes the FDA's proposed Produce Rule that would require irrigation water for over 200 fresh produce varieties to meet numeric water quality standards for primary contact recreation.

Proposes that water users would be required to test irrigation water, immediately cease use of non-compliant water, treat water to meet recreation standards, or obtain alternative irrigation supplies.

States compliance with the proposed rule would be impossible or impractical throughout much of Idaho and would eliminate many existing surface irrigation water supplies from continued use.

Supports enactment of federal legislation by Congress to prohibit the FDA from adopting the proposed Produce Rule or any numeric water quality standard for irrigation water.

Directs the House Chief Clerk to transmit copies of this memorial to Congress leadership, Idaho's congressional delegation, and the FDA Commissioner.
