Amends Section 39-4403 of Idaho Code to revise the definition of "restricted hazardous waste" in hazardous waste management law.

Expands the definition to clarify that restricted hazardous waste includes byproduct, source, and special nuclear materials regulated under the federal Atomic Energy Act of 1954, except as specifically provided for certain exclusions.

Excludes radiologically contaminated waste materials from "Formerly Utilized Sites Remedial Action Program (FUSRAP)" sites administered by the U.S. Army Corps of Engineers from the restricted hazardous waste definition when disposed of pursuant to contracts existing on July 1, 2001.

Excludes byproduct materials and devices or equipment authorized by the U.S. Nuclear Regulatory Commission under the federal Energy Policy Act of 2005 from restricted hazardous waste classification.

Excludes materials exempted or released from radiological control or regulation under the Atomic Energy Act of 1954 that are disposed of in commercial hazardous waste facilities as regulated by Idaho state rules and permit requirements.
