AI Summary

  • Amends Idaho Code Section 44-1001 to clarify that state and local public works employment requirements shall not conflict with federal labor preference laws for honorably discharged members of the armed forces.

  • Maintains existing requirement that contractors employ 95% bona fide Idaho residents on state, county, municipal, and school construction, repair, and maintenance work.

  • Allows contractors to employ up to 10% nonresidents when contracts involve 50 or fewer employees, provided Idaho residents receive preference.

  • Establishes that federal veteran preference laws for members of the United States armed forces (airmen, soldiers, sailors, and marines) override Idaho's residency preference in projects using federal aid funds.

  • Affirms that federal statutes prohibiting unlawful discrimination among U.S. citizens take precedence over state residency requirements in federally-funded public works projects.

Legislative Description

Amends existing law to provide that in work involving the expenditure of federal aid funds, specified law shall not be enforced in such a manner as to conflict with or be contrary to the federal statutes prescribing a labor preference to honorably discharged members of the United States armed forces, including airmen.
